Terms of Service

This portal is operated on behalf of the photographer or studio identified on this website ("Photographer"). The portal platform, including all software, design, and underlying technology, is provided by Arc.hive, an MK Studio subsidiary ("Platform Provider"). By accessing or using this portal, you ("Client") agree to be bound by these Terms of Service. If you do not agree, please do not use this portal.

Portal & Services

This portal provides a secure online environment for managing the post-production workflow between you and your Photographer. This may include image proofing and selection, review and approval of edits, payment processing, invoicing, and delivery of final files. Access to specific features depends on the services agreed between you and your Photographer.

Access & Authentication

Access to this portal is provided via password-protected pages and session-based authentication. You are responsible for keeping your access credentials confidential. The portal may use anonymous authentication and browser-based sessions to manage your access and maintain your selections across devices. By using the portal, you consent to this session management.

Intellectual Property

The portal platform — including all source code, software architecture, user interface design, visual styling, page templates, workflow logic, and documentation — is the exclusive intellectual property of the Platform Provider and is protected under the Australian Copyright Act 1968 and applicable international copyright laws, including the Berne Convention.

You may not, directly or indirectly:

  1. Copy, reproduce, modify, adapt, or create derivative works based on any part of the portal software or design.

  2. Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code or underlying architecture of the portal.

  3. Remove, alter, or obscure any copyright, trademark, or proprietary notices within the portal.

  4. Use automated tools, scrapers, bots, or similar technology to access, extract, or collect data or content from the portal.

  5. Sublicence, resell, redistribute, or make the portal (or any part of it) available to any third party.

Photographs, images, and creative works displayed within the portal remain the intellectual property of the Photographer and/or their respective rights holders. Image selections, proofing submissions, and review annotations you make within the portal are stored for the purpose of delivering services and do not transfer any ownership of the underlying images to you unless expressly agreed with your Photographer.

Privacy & Data Handling

The Platform Provider and Photographer are committed to handling your personal information responsibly and in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

When you use this portal, the following information may be collected and stored:

  1. Name, email address, and company name as provided by you or your Photographer for invoicing and communication purposes.

  2. Session and authentication data, including anonymous user identifiers, timestamps, and access logs, used to manage portal access and maintain your selections.

  3. Image selections, review decisions, annotations, and submission data generated through your use of the proofing and review features.

  4. Payment and transaction records processed through the portal's integrated payment systems.

Your data is stored securely using industry-standard cloud infrastructure. Personal information is not sold, rented, or shared with third parties except as necessary to deliver the services described above, comply with legal obligations, or with your explicit consent.

Email notifications related to your project (such as submission confirmations, payment receipts, and file delivery notices) are sent via third-party email services on behalf of your Photographer. You may contact your Photographer directly to manage your communication preferences.

For international clients: your data may be stored and processed on servers located outside your country of residence. By using this portal, you consent to this transfer of data.

Payments & Refunds

Where payment is required, pricing and payment terms are set by your Photographer and displayed within the portal. Payments may be processed via integrated card payment or bank transfer, as offered by your Photographer.

All prices displayed are exclusive of GST unless stated otherwise. For Australian clients, GST of 10% is applied in accordance with Australian tax law and itemised on your invoice.

Payment disputes, refund requests, and billing enquiries should be directed to your Photographer. The Platform Provider is not a party to the commercial agreement between you and your Photographer and does not process refunds on behalf of the Photographer.

Outstanding invoices remain payable regardless of whether final files have been delivered. Access to the portal and its features may be restricted if invoices remain unpaid beyond the agreed terms.

Limitation of Liability

The portal is provided on an "as is" and "as available" basis. While the Platform Provider takes reasonable steps to ensure the portal operates reliably and securely, no warranty is given — express or implied — regarding uninterrupted access, error-free operation, or fitness for a particular purpose.

To the maximum extent permitted by law, the Platform Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the portal, including but not limited to:

  1. Loss of data, image selections, review submissions, or payment records.

  2. Delays, interruptions, or errors in portal availability or functionality.

  3. Unauthorised access to your account resulting from your failure to safeguard credentials.

  4. Actions, omissions, or disputes between you and your Photographer.

Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law, including consumer guarantees relating to services being provided with due care and skill.

Third-Party Services

The portal integrates with third-party services for payment processing, cloud infrastructure, and email delivery. Your use of these services is subject to their respective terms and privacy policies. The Platform Provider is not responsible for the availability, accuracy, or conduct of third-party services.

Changes to These Terms

The Platform Provider reserves the right to update these Terms of Service at any time. Changes take effect when posted to this page. Continued use of the portal after changes are posted constitutes acceptance of the updated terms.

Governing Law

These terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from your use of this portal shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia, except where prohibited by local law.
